1. Who We Are

TaxCounsel is operated by Befree Ltd (“we”, “us”, “our”). We are the data controller responsible for your personal data under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

2. What Data We Collect

Account information (via Clerk):

  • Email address
  • Name (if provided)
  • Authentication tokens and session data
  • IP address and browser information

Data stored locally on your device:

  • Client names, references, and entity types you create
  • Tax advisory memoranda content
  • Firm settings (firm name, contact details, uploaded logo)
  • Usage counter for free memoranda

Data shared with AI services:

When you generate a memorandum, the details you enter (including client name, reference, and financial information) are securely sent to Anthropic's Claude AI for processing. This enables us to provide you with personalised, high-quality advisory output.

3. How We Use Your Data

  • Authentication: To verify your identity and manage your account (processed by Clerk)
  • Service delivery: To generate AI-powered tax advisory memoranda based on the information you provide
  • Local storage: To save your clients, memos, and settings on your device so they persist between sessions
  • Email delivery: To send memoranda via email when you choose to use that feature (processed by Resend)

4. Legal Basis for Processing (UK GDPR)

  • Contract performance (Article 6(1)(b)): Processing necessary to provide you with the TaxCounsel service
  • Legitimate interests (Article 6(1)(f)): To improve and secure the service
  • Consent (Article 6(1)(a)): For optional features such as email sending

5. Where Your Data is Stored

Good to Know

  • Your client data and memoranda stay on your device in your browser's local storage. We do not store this data on our servers, giving you full control.
  • We recommend using the Export Data feature in Settings to keep regular backups.
  • Authentication is managed by Clerk, AI processing by Anthropic, and email delivery by Resend. These trusted partners may process relevant data on servers outside the UK, with appropriate safeguards in place.

6. International Data Transfers

Some of our service providers (Clerk, Anthropic, Resend) are based in the United States. When your data is transferred outside the UK, it is subject to appropriate safeguards including Standard Contractual Clauses (SCCs) or equivalent protections as required by UK GDPR.

7. Data Retention

  • Local data: Retained on your device until you choose to delete it
  • Authentication data: Retained by Clerk for the duration of your account
  • AI processing: Anthropic may retain query data according to their own privacy policy
  • Emails: Retained by Resend according to their data retention policy

8. Your Rights (UK GDPR)

Under UK data protection law, you have the following rights:

  • Right of access: Request a copy of your personal data
  • Right to rectification: Request correction of inaccurate data
  • Right to erasure: Request deletion of your personal data
  • Right to restrict processing: Request limitation of how we process your data
  • Right to data portability: Receive your data in a structured, machine-readable format (use the Export Data feature in Settings)
  • Right to object: Object to processing based on legitimate interests
  • Right to withdraw consent: Where processing is based on consent

To exercise any of these rights, contact us at the email address provided in the application. You also have the right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk.

9. Cookies

TaxCounsel uses essential cookies required for authentication (set by Clerk). We do not use advertising or tracking cookies. Session cookies are necessary for the service to function and cannot be disabled.

10. Children

TaxCounsel is a professional tax advisory tool designed for qualified professionals. It is not intended for use by anyone under the age of 18.

11. Changes to This Policy

We may update this privacy policy from time to time. We will notify you of significant changes by posting a notice within the application. Your continued use of TaxCounsel after changes constitutes acceptance of the updated policy.
